    Dated 13 July, 1907.
    He was applying for a share of monies due to the Eastern Cherokees by the Act
    of Congress approved 30 June, 1906.

    Father of Josephus: Erb B. Prater born in GA. died in 1858, and his mothers
    maiden name as Kittura Prater, born in South Carolina, died in 1900.
    His grandparents on his fathers side are given as Joseph Prater and Mary
    Boyd Prater, and grandparents on his mothers side are given as Jeremiah
    Prater and Jennie Hendricks Prater.
    He listed a brother R.W. Prater, born 1848, resideing at Carroll, Texas;
    a sister Lou Prater, born 1852, residing at Sherman, Texas; a half-brother
    J.J.Knoles, born 1860, residing at Madill, Indain Territory.

    A sworn statement submitted by Josephus dated 29, Aug., 1908 at
    Tishomingo, Okla. which states:
    "My name is Josephus C.F. Prater, my post-office is Mead, Okla.;
    I was born in Smith Co., TX. in 1854; I claim relationship to the Cherokee
    Indans through my mother, whose maiden name was Kittura Praer; my father and
    mother were first cousins; my mother was born near Greenville, S.C. about
    1830; she claimed through her mother, whose maden name was Jennie Hendricks;
    she was born in South Carolina and she was one-quarter Cherokee; my mother
    after her marriage moved to Georgia and from there came to Texas about 1848;
    if any of the Hendricks moved west, I never heard of it; I never heard my
    parents say that they were enrolled as Indians; my people never received any
    money or land from the government."

    His headright land survey, origianally owned by him, is on the Neches
    River south of Mt. Sylvan.

    Erb Boyd came to Smith Co., Tx. with his two brothers Thomas and Samuel.
    They were born in South Carolina and moved to Ga., Ala, and then to Texas.
    Erb's brother Samuel was married while at Gunters Crossing, Alabama.
    Smith Co.,Tx. land grant to E.B.Prater for 320 acres 11.5 miles west of Tyler
    with the western boundry being the Neches River.

    Notes:

    Died in North Texas hospital for the Insane in Terrell, TX.
    She was commited in 1900 and she died about a year later.

    She purchased land from James J. Kuykendall and his wife Frances
    Angeline (During) Kuykendall in 1858 Smith Co., TX.
    There are ties between the Kuykendall, Prater, Wright, Waldron
    and Duncan families. The Duncan's were an allied family to
    the Praters (Prathers). E.B. Praters nephew, Riley Prather, married
    the widow of Marion Josiah Duncan. Her name was Elvira (Davis) Duncan.
    She was almost full blood Cherokee.

    Catherine was called "Katurha" which is Cherokee for the name Catherine.
    She may have also been of Cherokee heritage.

    Katurha Hendricks Prater was a 1st. cousin to her husband, Erd Boyd Prater.

    Joseph Praters mother Susannah, widow of Philip Prater, who was to benefit
    from a Certificate of Pension issued 23 Apr., 1850, was named by Mitchel
    Norton, Administrator

    Susanna Prater (now Hammond) requested an increase in her former husband's
    pension which commenced 4 Mar., 1831 for $61.33 per annum and ended 9 Aug.,

    Several Boyd families from N.GA. are looking for ancestors with the same
    migration pattern as you Mary Boyd.
    Several came from Halifax, VA. to that general area of S.C. then on to the
    "Federal Road" across the Cherokee Nation from Hall Co., GA. through what is
    not Forsyth, Cherkee, Floyd Co's. GA. into AL.
    Is there any additional info. that might be a clue to which of the groups she
    might belong?
    My GG.Grandfather, Robert A Boyd was in Pickens Dist., S.C. in 1850, and
    between 1858/60 moved to Forsyth Co., GA., then in very late 1800's on to Al.
